DMJ Custom homes raid!!

According to sources:

"BPD tells me they served a search warrant yesterday at the company owner's home in the 11-thousand block of Brightwater. He was not taken into custody. The warrant was for an investigation into "theft of construction funds."



BAKERSFIELD - Bakersfield Police raided have the home of a local homebuilder accused by some of his clients of taking their money and running.

The Bright Water Way home of Donald Juhasz was searched Tuesday, according to Bakersfield Police.

No arrests have been made, and no charges have been filed.

Juhasz created DMJ Customs in 2005. Since then, close to a dozen people have come forward saying Juhasz took money and didn't complete work.


The fireplaces are gone. They were repossessed from the half-built structure Ammanda and Thomas Meek thought would be their dream home.

All Burt Valencia has to show for his effort to have a custom home built by DMJ Customs, a home builder, is a sign with his family name on it which stands on his empty one-acre lot at the corner of Renfro and Henderson.

Ammanda Meek's home was never completed. She says the contractor took her money, leaving her with a partially constructed home. "I hate coming here, it just kills me," she said as she walked through the partially built house.

"It was 2,600 square feet, full custom," Ammanda Meek said. "It's framed and it's got a roof. That's as far as it got."

Recall the story by the Bakersfield Californain (I cant find the link) on the DMJ Custom homes fiasco. We can now confirm the story posted by privateeye :

Finally local government is taking action with fraudsters!! BPD raided DMJ Custom Homes aka Don Juhasz home/office yesterday. No one was home at the time, however, 3 boxes were taken from his home. Hopefully IRS will be next to collect on unpaid taxes. Hope the coward shows his face soon. Maybe he could be on KGET's panel as a local rip-off artist.

Juhasz was always low life and I'm glad he got canned from "the Farm". Unfortunately, however his firing lead to his need for revenue and so he created this semi-elaborate building scam. Hopefully justice will be served! I hope there is a special place for those who prey upon "friends"!

I would really like to know how Juhasz got so much construction money on the Meek house when only about $40000 in work had been done. There is just something wrong with that picture. Someone really screwed up. Normally draws are done after inspections have been passed. The bank needs to hand over the paperwork they were provided for the draws. Only other thing is the bank screwed up and made the draws to big? What bank in this day hands over the money to the builder when the construction loan is in the name of the owner????? Stay tuned I smell more dead fish!!!!!!

Do even a small fraction understand how badly they've been screwed? Only subs who "pre-lien" are known to lenders, and in residential construction the majority of subs will not bother to do this. Even if they do, no residential lender will require lien releases until just prior to issuing the final draw - if that.

As to verifying that the work is done prior to issuing draws - typically they will verify the first draw or two to make sure you are getting out of the ground, and then not again until torward the end with finish work draws.

Funny how all the subs had a pre lien on the Meek house isn't it. Now there were two draws so did the lender verify???? Checks were to be in both names from what I understand Wing that lol

Hmmm....Public record reflect Don & Denise Juhasz have title to 5 local properties in which 3 of the 5 are in foreclosure. DMJ Customs Inc. has title to 3 properties in which 1 of 3 are in foreclosure. Does Don and Denise have any employees/friends that have fraudgently taken out loans? Sound familiar?
Scotty-Let's do the math again. KGET reports a dozen families have been duped by Juhasz. Ammanda Meek states her family was duped for $525,000.00!! The grand total would be in excess of a $6,000,000.00 GRAND theft and this guy can't pay his mortgage?
BB-What about a wall of shame with photos of these local fraudsters. Does anyone have a photo of Juhasz?

REGARDING LIENS

This is how the system works in the large scale construction business, including commercial, retail, office, industrial and even housing tracts:

Any subcontractor who works on the project must Pre-Lien the job within 30 days of starting work in order to establish lien rights to the project. This Pre Lien will show the total contract amount and is sent to the general contractor, owner and lender, and should also be recorded with the county.

With every monthly draw, the sub must provide a “Lien Release” in the amount of his draw.

With his final bill he will provide a “Conditional Upon Final Lien Release” stating that the current draw will satisfy what is owed on the contract, minus retention (usually retention of 10% is withheld from all draws).

Lastly (and sometimes concurrently), the sub will provide a “Unconditional Upon Final Lien Release” stating that the payment of retention will satisfy all obligations and will cause the sub to forfeit his lien rights to the property.

There is more to it then that, but that's the basics.

I am a large commercial builder who has only built 8 or 10 custom homes, for myself and my family.

My experience has been that, out of 30 or so subs on a typical custom home job, maybe 5 will Pre Lien. Maybe.

I have NEVER been asked by the lenders to provide sub lien releases prior to progress payments.

I have been asked ONCE to provide Unconditional Upon Finals prior to receiving the final draw.

Okay I have looked at the Meek home. It is not what I would call custom!!! This guy Juhasz was more a high end tract builder. For what has been done on that home I can definately say he got too much money from the draws and since the loan was in the Meeks name they would have to sign. Did they?

The typical "Build-to-Suit" custom home deal is structured so that the contractor can request and receive draws without the owners approval.

This is to protect the contractor from owner non-payment.

It was CUSTOM! I had the plan in my mind. For your info most of the house was taken from an old Sam wilkerson plan.I did NOT use Juhasz plans......As for National City they are refusing to even follow up on a fraud report I filed months ago. Juhasz forged my docs to have the $$$$ wired to his own personal bank account. and national city is scoffing at my complaint. He did did the roof early so he was able to take out the a second draw before he skipped town....Hello premeditation......He's a dirt bag!!!!

On the homes I’ve built, the only subs who pre lien’d were those that didn’t know me. If ALL of the subs pre lien that means that 1.) they don’t know the general contractor or 2.) they DO know him and they don’t trust him.

Either way it is a huge red flag.

Duh hello of course they didn't trust him the subs ALWAYS have the dirt on the builders. The good subs build the house themselves the builder just puts his name on it. They watch and hear stories from the buyers, and in this case it didn't take a genius to know the guy was moving big money, and subs were showing up at the finished houses looking to be paid by the owners. Mrs Meek unfortunately just got caught at the end when he was going down.

The "RED FLAG" would alert you to the fact that you have a green contractor or one with a sketchy reputation with subs.

That knowledge could have promted you to monitor his actions very closely and to protect your financial best interest.

You don't need to collect from the contractor IF the bank disbursed funds improperly. IF that is the case, you will be made whole by the bank.

IF what you are saying is accurate, you will get the funds that were improperly disbursed.

The person who told me the subs build the house if they are good subs was one of the biggest truly custom home builders in Bakersfield
He told me he used to drive by homes and be amazed at what the subs had done they just knew when to go in without a call from him.

Those huge mega companies have floors of attnys who stay on retainer--they don't care about legal fees/costs. It's already built into their business model. Meanwhile the system is upside down...the wronged party must pay to prove they are innocent.

It appears Mr. Juhasz was paying individuals to obtain construction loans with Bank of America. Upon completion of the home, the individual would grant deed as a "gift" back to DMJ Custom Homes. To be continued...

If what meek has said is accurate, her action will not be against the builder but rather will be against the bank, where there's plenty of "blood".

However, that depends on the accuarcy of meek's account - that the bank improperly disbursed funds based on forged documents.

Based on her reluctance to pursue the bank, I question whether this is a simple case of forgery for which the bank would be clearly liable - just as they would in the case of a forged check.

But clearly she's been scammed and deserves justice, and you are correct her chances of reimbursement from the builder are slim.

What's the deal with these "gift" grant deeds? I remember reading on here a long time ago that there was one of these gift transfers between Crisp and Bynum on the Stockdale buildings but I don't really know what the significance is.

Deal is he (Juhasz) paid people to get loans with their credit, which he used. At the right time the straw buyer gifted the property to Juhasz with no tax paid to the county.
Juhasz is a smaller Crisp and Cole but just as big a crook
